Customers who fail to request a receipt or invoice will be fined 5,000 liras (more than 130 euros), according to a draft of a new law published in the Official Gazette of the Republic, which complements another law published on 2 August – Law 7524 – that imposed fines on companies and businesses that fail to issue receipts or invoices.
According to the Turkish daily Hürriyet, the customer will not receive a fine if he or she notifies the authorities, within 5 working days of the date on which the receipt/invoice should have been issued, that he or she did not receive any such document: in such cases, the customer can avoid the fine as long as the notification is made before the authorities establish the infringement.
In order to clarify the new rules for citizens, the draft of the new law provides several scenarios as examples. In one example, it explains that if a taxpayer buys a gift for a child and later realises that he did not obtain a receipt, both the customer and the seller will be fined: the former for not asking for a receipt or invoice, and the latter for not issuing one.
Another example describes a hypothetical situation in which an audit reveals that a customer did not receive a receipt for purchases made from a company; in this case the customer in question would receive a fine of 5,000 liras, but in addition the company would also receive a fine, which in this case would be 40,000 liras for being the 4th time in a year that the company is found not to have issued a receipt.
Penalties of up to 2,700 euros for companies
The new legislation foresees fines not only for customers but also for vendors that will gradually increase each time the authorities detect that a company or business has not issued receipts or invoices for a sale: 20,000 liras for the 2nd time, 30,000 liras for the 3rd time, 40,000 liras for the 4th time, 50,000 liras for the 5th time, and 100,000 liras – almost 2,700 euros – from the 6th offence onwards.
With this series of measures, the Turkish government would seek to combat fraud and tax evasion at a time when many consumers and businesses prefer not to issue receipts and invoices to avoid the effects of rising prices due to inflation.
